Welcome to StormRack. By accessing or using our website (https://stormrack.com/) and our cloud server / VPS services, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must not use the website or our services.

1. Definitions & Scope

“Services” means any cloud computing, VPS (Virtual Private Server), server hosting, managed or unmanaged hosting services provided by StormRack. “You”, “your” means the user or customer accessing or using the Services. “We”, “us”, “our” means StormRack.

2. Acceptance of Terms

By signing up for or using our Services, you acknowledge that you have read, understood and agree to be bound by these Terms. Use of the Services constitutes acceptance of these Terms now and as modified in the future.

3. Account Registration & Security

You must provide accurate, current and complete registration information and promptly update any changes. You are responsible for safeguarding your account credentials and for all use of your account, including any unauthorized use.

4. Provision of Services; Billing & Payment

We will provide the Services in accordance with the plan you selected and paid for. All fees are due according to the billing terms. Failure to pay may result in suspension and/or termination of Services. Unless otherwise stated, payments are non‑refundable.

5. Acceptable Use / Prohibited Activities

You agree to use the Services only for lawful purposes and in compliance with our Acceptable Use Policy. Prohibited activities include, but are not limited to:

  • Hosting or transmitting illegal, obscene, infringing or harmful content;
  • Using the Services for unsolicited bulk email (spam), phishing, IRC bots, proxy services, malware distribution, P2P file‑sharing networks, cryptocurrency mining without authorization, etc.;
  • Attempting to gain unauthorized access to any network or system or interfering with other customers’ use of the Services;
  • Exceeding resource usage or bandwidth allocations in a way that impacts other customers, unless specifically permitted by your plan.

6. Intellectual Property Rights

All content provided by StormRack — including text, graphics, logos, software, code, images and other materials — is either owned by us or used under licence. You may not reproduce, distribute, modify or use such content without our prior written consent.

7. User Content

If you upload, submit or store content (“Your Content”) in or via our Services, you retain ownership of Your Content. By doing so, you grant StormRack a non‑exclusive, worldwide, royalty‑free licence to access, use, host, store, reproduce, modify, and display Your Content solely for the purpose of providing the Services. You represent and warrant that Your Content does not violate any law or third‑party rights.

8. Data Backup & Responsibility

Unless otherwise stated in your service plan, you are responsible for backing up your data. We do not guarantee recovery of Your Content after termination or suspension of Services. By using the Services, you agree that you should maintain your own backups.

9. Disclaimers & No Warranties

The Services and all information, software, products and other content offered through the Services are provided “as is” and “as available”. StormRack disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non‑infringement and uptime. We do not guarantee that the Services will be uninterrupted or error‑free.

10. Limitation of Liability

To the fullest extent permitted by applicable law, StormRack, its affiliates, officers, directors, employees, agents, licensors or service providers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, business interruption or goodwill arising out of or relating to the Services, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend and hold harmless StormRack and its officers, directors, employees, agents, licensors and service providers from and against any and all claims, liabilities, damages, losses, costs or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms or your violation of any rights of another.

12. Changes to the Terms

StormRack reserves the right to modify these Terms at any time by posting the modified version at this location. The “Last updated” date at the top will reflect when changes were made. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.

13. Governing Law & Jurisdiction
